About Free Play Bay

Free Play Bay provides free browser games, game pages, community features, game creation tools, ratings, reviews, leaderboards, installable app features, and related services. Free Play Bay may include content created by Free Play Bay, users, creators, automated tools, artificial intelligence tools, or third parties.

Free Play Bay may update, change, remove, rename, replace, limit, or discontinue any game, feature, service, page, account function, leaderboard, review, rating, download feature, or app feature at any time.

Accounts and Eligibility

• You are responsible for keeping your account login information secure.
• You may not create accounts using false, misleading, stolen, automated, or unauthorized information.
• You may not sell, transfer, share, or misuse accounts in a way that harms Free Play Bay, other users, or the integrity of the site.
• You must provide accurate information when creating or using an account.
• If you are under the age required by law to agree to these Terms, you may use Free Play Bay only with permission and supervision from a parent or legal guardian.
• Children under 13 should not submit personal information to Free Play Bay. If a parent or guardian believes a child submitted personal information, they should contact Free Play Bay so the information can be reviewed and removed when appropriate.

User Submissions and Free Play Bay Ownership

“User Submissions” means anything you create, upload, submit, publish, post, import, send, rate, review, or otherwise provide to Free Play Bay. This includes games, game files, code, scripts, prompts, titles, names, descriptions, icons, images, artwork, audio references, reviews, ratings, comments, profile content, leaderboard entries, feedback, suggestions, bug reports, and any other materials or data submitted to or through Free Play Bay.

To the fullest extent permitted by law, you assign to Free Play Bay all rights, title, and interest in and to any User Submission that is created for, uploaded to, submitted to, published on, or made available through Free Play Bay. This means Free Play Bay may own, control, host, use, modify, publish, remove, monetize, promote, distribute, and manage those User Submissions as part of the Free Play Bay platform.

If any rights in a User Submission cannot legally be assigned, you grant Free Play Bay a perpetual, irrevocable, worldwide, royalty-free, fully paid, sublicensable, transferable license to use, host, store, copy, reproduce, modify, edit, adapt, translate, publish, display, perform, distribute, promote, market, monetize, create derivative works from, remove, and otherwise exploit the User Submission in connection with Free Play Bay, related services, advertising, promotion, archives, backups, security, moderation, and platform operations.

You agree that submitting content to Free Play Bay does not create employment, partnership, joint ownership, a contractor relationship, a royalty right, a revenue share, or any right to payment unless Free Play Bay separately agrees in a written agreement signed or clearly accepted by Free Play Bay.

Free Play Bay is not required to publish, host, display, preserve, return, restore, or continue making available any User Submission. Free Play Bay may edit, reject, remove, hide, disable, restrict, delete, or unpublish any User Submission at any time, with or without notice.

Your Responsibility for Submissions

You are solely responsible for anything you submit to Free Play Bay. You represent and warrant that you have all rights, permissions, and authority needed to submit your User Submissions and to grant the ownership, assignment, and license rights described in these Terms.

You must not submit anything that infringes or violates another person’s intellectual property rights, privacy rights, publicity rights, contract rights, confidentiality rights, or legal rights. You must not submit content that you copied from another website, game, app, creator, artist, user, source code repository, marketplace, or service unless you have the legal right to submit it to Free Play Bay.

You are responsible for content generated with artificial intelligence or other automated tools. Using AI to create a game, prompt, image, description, title, or other material does not remove your responsibility to make sure the content is lawful, safe, allowed, and does not violate someone else’s rights.

Prohibited Content

You may not submit, upload, publish, create, link to, promote, or distribute content through Free Play Bay that includes or involves:

• Illegal content, illegal activity, instructions for crime, or content that violates applicable law.
• Copyright infringement, trademark infringement, stolen games, stolen artwork, stolen code, stolen music, or unauthorized use of another person’s work.
• Malware, viruses, spyware, credential theft, phishing, hidden miners, malicious scripts, harmful downloads, or deceptive code.
• Sexual content, pornographic content, exploitative content, or content involving sexualization of minors.
• Harassment, threats, bullying, doxxing, stalking, intimidation, or targeted abuse.
• Hate, extremism, violent threats, terrorism support, or content attacking people based on protected characteristics.
• Graphic violence, self-harm encouragement, dangerous challenges, or instructions that create a serious risk of harm.
• Scams, fraud, misleading promotions, fake giveaways, fake rewards, deceptive monetization, or impersonation.
• Personal information of another person without permission.
• Content designed to bypass Free Play Bay security, token systems, access controls, rate limits, advertising rules, moderation, or account protections.
• Anything Free Play Bay determines is unsafe, harmful, abusive, unlawful, misleading, low quality, spammy, or inappropriate for the platform.

Prohibited Conduct

• Use Free Play Bay only for lawful purposes.
• Do not damage, overload, scrape, copy, reverse engineer, attack, interfere with, or disrupt the site.
• Do not use bots, exploits, automated requests, fake traffic, fake accounts, click farms, review manipulation, rating manipulation, or abusive activity.
• Do not attempt to bypass security, token gates, game access controls, account systems, download protections, advertising systems, or technical restrictions.
• Do not upload or submit code that collects data from users without permission or sends data to unauthorized third parties.
• Do not interfere with other users, creators, games, reviews, ratings, leaderboards, or site operations.
• Do not use Free Play Bay to violate another service’s terms, scrape other websites, or distribute content that you are not allowed to distribute.

Moderation, Removal, Suspension, and Bans

Free Play Bay may review, moderate, edit, restrict, remove, hide, disable, delete, or refuse any content, account, game, review, rating, leaderboard entry, upload, page, or feature at any time, with or without notice.

Free Play Bay may suspend, restrict, ban, delete, or terminate your account or access to the site at any time, for any reason, including suspected abuse, security risk, illegal activity, violation of these Terms, user complaints, platform risk, or conduct that Free Play Bay determines may harm the site, users, creators, advertisers, partners, or the public.

Free Play Bay is not required to provide warnings, explanations, appeals, backups, exports, refunds, restoration, or continued access after content is removed or an account is restricted, suspended, banned, deleted, or terminated.

Games, Saves, Downloads, and Availability

Games are provided for entertainment. Games may be experimental, user-created, AI-assisted, incomplete, or updated over time. Free Play Bay does not guarantee that any game, save file, score, favorite, review, rating, leaderboard, download, offline feature, or app feature will always be available, accurate, preserved, compatible, secure, or error-free.

Browser storage, local saves, cached files, PWA downloads, and offline features may be lost or stop working because of browser settings, device storage, updates, removals, technical issues, or changes to Free Play Bay. Free Play Bay may remove or disable downloaded or cached game access when needed for security, licensing, moderation, or platform control.

Ratings, Reviews, Leaderboards, and Community Features

Free Play Bay may provide ratings, reviews, play counts, favorites, downloads, leaderboards, creator rankings, comments, or other community features. These features may be changed, reset, recalculated, moderated, hidden, removed, or disabled at any time.

Do not manipulate ratings, reviews, play counts, scores, leaderboards, accounts, favorites, downloads, or rankings. Free Play Bay may remove or adjust suspicious, fraudulent, abusive, automated, duplicate, misleading, or low-quality activity.

Intellectual Property and Platform Content

The Free Play Bay name, site design, layout, logos, branding, pages, systems, code, text, graphics, databases, features, and platform materials are owned by Free Play Bay or their respective owners. You may not copy, redistribute, sell, republish, clone, frame, scrape, or exploit Free Play Bay materials without permission, except as allowed by law.

Some games or materials may include third-party content, open-source content, public-domain content, licensed content, user-submitted content, or AI-assisted content. All rights remain with their lawful owners unless assigned or licensed to Free Play Bay under these Terms or another agreement.

Copyright and Intellectual Property Complaints

If you believe content on Free Play Bay violates your copyright, trademark, privacy, publicity, or other rights, contact Free Play Bay with enough information to identify the content, explain the claimed violation, and verify that you are the rights owner or authorized to act for the rights owner.

Free Play Bay may remove or restrict content that appears to violate rights, laws, platform rules, or these Terms. Free Play Bay may also terminate accounts of users who repeatedly infringe or repeatedly submit content that creates legal or platform risk.

Advertising, Affiliate Links, and Monetization

Free Play Bay may display advertising, affiliate links, sponsored content, promotional content, or other monetization features to support the site. Ads may be provided by third-party advertising partners, including Google AdSense or other ad networks.

Do not click ads in a misleading, automated, accidental, fraudulent, or abusive way. Do not manipulate ad systems, impressions, redirects, affiliate links, tracking systems, or monetization features.

Free Play Bay may monetize games, pages, user submissions, platform content, traffic, app features, and related services without owing payment, royalties, attribution, or revenue share unless a separate written agreement says otherwise.

Third-Party Links and Services

The site may link to or use third-party websites, services, APIs, login providers, advertisers, analytics services, app platforms, Discord, embedded content, payment services, or other resources. Free Play Bay does not control third-party services and is not responsible for their content, policies, security, availability, or actions.

Your use of third-party services may be governed by the third party’s own terms and privacy policies.

Privacy

Your use of Free Play Bay is also governed by our Privacy Policy and, where applicable, our Cookie Policy. These policies describe how Free Play Bay may collect, use, store, and share information.

No Warranties

Limitation of Liability

To the fullest extent allowed by law, Free Play Bay and its owners, operators, affiliates, service providers, and partners are not liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages related to your use of or inability to use Free Play Bay.

This includes damages or losses related to games, accounts, content removal, account bans, lost saves, lost scores, lost data, lost rankings, lost submissions, device issues, third-party services, advertising, security incidents, site errors, downtime, or changes to the platform.

Indemnification

You agree to defend, indemnify, and hold harmless Free Play Bay and its owners, operators, affiliates, service providers, and partners from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from your use of Free Play Bay, your User Submissions, your violation of these Terms, your violation of law, your violation of another person’s rights, or your misuse of the platform.

Unless a different rule is required by applicable law, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
